Privacy Policy
This policy explains how NetMovIA collects, uses and protects your personal data when you use the platform (as a subscriber or creator), in accordance with the General Data Protection Regulation (GDPR) and applicable French law.
1. Data controller
The data controller for information collected through the NetMovIA website and platform is Ludovic Gosselin, as the publisher of the NetMovIA service, who can be contacted exclusively at the following address: support@netmovia.com.
2. Data we collect
The main categories of data processed are as follows:
- Account data: email address, username, password (stored in encrypted form), profile preferences.
- Platform usage data: viewing history, video progress, number of views given and received, unlocking of badges and avatars, player settings.
- Billing data: as of today, no paid subscription and no payment feature is active on NetMovIA. As a result, no complete banking data is currently collected or stored by NetMovIA. If paid offers are launched later, this policy will be updated accordingly.
- Data relating to Creator status: as of today, no creator payment mechanism and no KYC verification process is active. Any identity, tax or banking data required for a future remunerated activity would only be collected once these features are effectively activated, with a prior update of this policy.
- Technical and security data: IP address, technical session identifiers, login timestamps, security and error logs.
- Cookies and technical trackers: see the Cookies Policy for more details.
As of today, NetMovIA is offered with free access, without any paid subscription or effective creator remuneration mechanism. The elements above relating to billing and payment data describe the operation planned for a future commercial phase: such data will only actually be collected when the paid service is officially launched, together with the creation of the appropriate legal structure and an update of the present policies.
NetMovIA currently allows the use of official avatars provided by the platform and, depending on the features available on the user account, the upload of a profile image by the user. These elements are processed only for account display and personalization purposes.
3. Purposes and legal bases
Your data is processed for the following purposes:
- Account management and provision of the service (access to the platform, video playback, progress tracking, badges system) — legal basis: performance of a contract.
- Site security and fraud prevention (login logs, abuse detection, access management) — legal basis: legitimate interest.
- User support and handling of requests (responses to messages, technical assistance) — legal basis: legitimate interest.
- Sending information relating to the operation of the service (important changes, terms updates, account-related notifications) — legal basis: legitimate interest.
- Management of billing and accounting obligations — legal basis: legal obligations.
4. Recipients and processors
Your data may be transmitted only to the persons and providers who need to access it in the course of their duties:
- NetMovIA technical and support team.
- Hosting provider for the website and database.
- Secure payment providers for processing subscriptions.
- Technical providers for video storage and delivery.
When these providers act on our behalf, they are bound by a data processing agreement and may only process your data in accordance with our instructions.
5. Data location and transfers outside the EU
Data is mainly hosted within the European Union. If some providers are located outside the EU or use servers outside the EU, transfers are governed by mechanisms recognised under the GDPR (adequacy decisions, standard contractual clauses or other appropriate safeguards).
6. Data retention periods
Data is only kept for the period strictly necessary for the purposes pursued:
- Account and profile data: kept as long as the account is active.
- Inactive account: main data is deleted or anonymised after 24 months of inactivity, subject to longer legal obligations.
- Billing data: kept for up to 10 years in accordance with accounting and tax obligations.
- Technical and security logs: kept for a maximum of 12 months, unless longer retention is required in case of disputes or security investigations.
If the user deletes their account, the personal data associated with the account is removed from our systems, except where certain data must be retained to comply with a legal obligation or for the defence of our rights. Some aggregated and anonymized statistics, which no longer allow the user to be identified, may be retained for the operation and overall analysis of the platform.
7. Security
NetMovIA implements reasonable technical and organisational measures to protect your data (access management, encrypted passwords, logging of certain sensitive actions, regular updates).
As no system is completely invulnerable, we undertake to react as quickly as possible in the event of an identified security incident.
8. Your rights
Under the conditions set out in the regulations, you have the following rights over your personal data:
- right of access and rectification;
- right to erasure (“right to be forgotten”);
- right to restriction of processing;
- right to object, in particular where processing is based on legitimate interest;
- right to data portability for data you have provided, where processing is automated and based on consent or on a contract.
To exercise your rights, you can contact us at: support@netmovia.com. Where processing is based on your consent, you may withdraw that consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
If, after contacting us, you consider that your rights have not been respected, you may lodge a complaint with the competent supervisory authority: CNIL (France) — cnil.fr.
