Creator Terms — NetMovIA

1. Purpose and contractual hierarchy
These Creator General Terms of Use and Sale (“Creator Terms”) set out the rules applicable to users who wish to publish, distribute and, where applicable, monetise their audiovisual works on the NetMovIA platform (hereinafter “the Platform”).
They supplement the general Terms of Use and any general Terms of Sale available on the site. In the event of any inconsistency, the specific provisions of these Creator Terms prevail for anything relating to Creator status and monetisation of content.
As of today, NetMovIA is offered with free access and the features relating to paid subscriptions, the full Studio mode and creator remuneration are in a preparation phase. The provisions of these Creator Terms relating to paid offers, revenue sharing and payout thresholds describe the intended operation and will only become effective at the time of the official launch of the commercial phase, which will be announced on the Platform and accompanied by an update to the contractual information.
2. Access to Creator status
Basic access to the site (public pages, information, possible trailers) is open to everyone. Access to publishing and monetisation features is restricted to adult users (18 years and over).
To become a Creator, the user must:
- create a NetMovIA account with a valid e-mail address, a username and a secure password;
- choose an offer including access to the Creator / Studio mode (see Article 3);
- upload at least one film or audiovisual work that complies with these Terms;
- obtain validation and publication of this first film by NetMovIA.
Creator status is only fully acquired once the first film has been published on the Platform. Before this step, the user is still considered a simple Subscriber / Viewer.
3. Offers related to Creator mode
Creation features and possible monetisation of works are accessible through different offers that may evolve over time. As of the date of the last update, NetMovIA notably provides:
- Free Offer: limited access to some site features, with no access to Studio mode and no monetisation.
- Subscriber-Creator Offer – €1.99 incl. tax / month: access to the NetMovIA catalogue, Creator / Studio mode and film publishing, with up to 1 simultaneous screen and streaming quality up to 1080p where available.
- Creator Premium Offer – €4.99 incl. tax / month: the same publishing and viewing rights, with up to 4 simultaneous screens and streaming quality up to 4K where available on the Platform.
NetMovIA reserves the right to modify the structure of its offers, their features and their prices at any time, with reasonable prior notice and in accordance with applicable consumer law. The terms in force are always those displayed at the time of subscription or renewal.
Subject to the options available in their account area, the Creator may change offer (e.g. switch from the Subscriber-Creator offer to the Free offer, or vice versa). Unless otherwise stated in the interface, the change takes effect at the next billing date.
4. Creator avatars and progression
4.1 Distinction between Creator Avatars / Subscriber Avatars
NetMovIA clearly distinguishes cosmetic elements linked to the Creator profile from those linked to the Subscriber profile. The two systems are independent:
- Creator avatars are visible and selectable only when the user is in Creator mode;
- Subscriber avatars (viewer) are visible and selectable only in Subscriber mode;
- a Creator does not see subscriber-exclusive avatars when browsing in Creator mode, and vice versa.
4.2 Creator avatars
Creator mode grants access to a dedicated collection of 12 Creator avatars. These avatars are purely cosmetic: they have no impact on ranking, visibility or remuneration of works.
As soon as Creator status is activated (validation and publication of the first film), the user may freely choose their Creator avatar from these 12 options and change it at any time from their account area.
4.3 Creator Stars (progression based on views)
Independently of avatars, NetMovIA operates a “Creator Stars” system to reward the popularity of published works. This system is based on the cumulative number of valid views of a Creator’s films.
For information only, and without prejudice to future technical changes, the star level is determined by the following thresholds:
- 1 star: from 200 views in total on all of the Creator’s films;
- 2 stars: from 2,000 views in total;
- 3 stars: from 10,000 views in total;
- 4 stars: from 50,000 views in total;
- 5 stars: from 250,000 views in total.
Only valid views are taken into account, i.e. views that meet the technical criteria defined by NetMovIA (for example: viewing by an authenticated subscriber, viewing of at least 80% of the video, absence of fraud signals, etc.).
Important: all works, regardless of their duration, can generate valid views. A valid view requires an authenticated viewing, at least 80% of the duration and no fraud signals. The same person can generate only one valid view per film over the film’s entire lifetime.
Technical details may evolve and are set out in the documentation or annexes available on the Platform.
NetMovIA may also create exceptional stars or special distinctions (artistic quality, community impact, events, etc.). The criteria for such distinctions are not made public in order to avoid bypassing or manipulation strategies.
5. Published content and Creator obligations
5.1 Nature of content
The Creator may publish films, series, trailers, excerpts or other audiovisual content, including content generated using APIs and artificial-intelligence tools (Runway, ElevenLabs, Pika, Luma, video or audio AI models, etc.).
It is strictly forbidden to publish content that:
- is pornographic, involving child sexual abuse, or sexually explicit;
- is gory, extremely violent or glorifies violence;
- incites hatred, discrimination, racism, xenophobia, homophobia or transphobia;
- glorifies terrorism, crimes or offences;
- is politically or religiously militant, propaganda or disinformation;
- is defamatory, insulting or seriously infringes the dignity of others;
- infringes intellectual property rights (copyright, trademarks, designs, etc.);
- uses the image or voice of recognisable third parties without authorisation;
- is obtained by capturing or bypassing technical protection measures (DRM, competing platforms, etc.).
5.2 Rights to the elements used
The Creator declares and warrants that they hold all necessary rights to publish their content on NetMovIA, including rights to images, videos, music, voices, scripts, logos, trademarks or any other element included in the film.
When using third-party APIs or AI tools, the Creator agrees to strictly comply with their terms of use (for example: prohibition of commercial use with a free plan, geographic restrictions, licence limitations, etc.). NetMovIA cannot be held liable for any non-compliant use of such services by the Creator.
6. Intellectual property and licence granted to NetMovIA
Unless expressly agreed otherwise, the Creator remains the holder of the intellectual property rights in their works and keeps full copyright.
By uploading content to the Platform, the Creator grants NetMovIA a worldwide, non-exclusive, royalty-free licence to:
- host, store and stream the content on the Platform;
- display it and make it available for viewing to NetMovIA subscribers;
- reproduce it as excerpts, still images or thumbnails in order to promote the film or the Platform;
- integrate it into recommendation, ranking or internal search tools.
NetMovIA does not resell Creators’ content to third parties and does not license it for uses outside the Platform, unless a specific written agreement is signed with the relevant Creator.
This licence remains in force for as long as the content is available on the Platform and ends within a maximum of 30 days after the effective removal of the content, in order to allow for the necessary technical operations (cache purge, CDN, playlists, etc.).
7. Monetisation model and revenue sharing
NetMovIA operates a remuneration system designed to reward genuine viewer engagement with works published on the Platform. When a Creator has at least one published film and holds an offer giving access to Creator mode, they may benefit from subscriber revenue sharing under the conditions set out below.
7.1 General structure of the model
A share of the revenue from paid subscriptions is allocated to a Creator Remuneration Fund. This fund is then distributed among creators according to the number of weighted valid views generated by their works (see Annex 1).
The current breakdown is as follows:
- 70% of subscription revenue is retained by NetMovIA to cover technical costs (hosting, encoding, CDN, APIs, security, development, support);
- 30% of subscription revenue is reserved for the Creator Remuneration Fund.
7.2 Remuneration criteria
The amount received by each Creator depends on their share of the total weighted valid views for all films on the Platform. Views are first recorded as valid views, then weighted by a coefficient linked to the creator’s position in the ranking (ranking by number of views, see Annex 1).
A valid view is one that meets the technical criteria defined by NetMovIA, in particular:
- viewing carried out by an authenticated user;
- reaching a given viewing threshold (for example: 80% of the duration);
- no fraudulent or automated behaviour;
- no duplication by the same user (one view per subscriber for the entire lifetime of the film).
The Creator understands and accepts that NetMovIA may regularly adjust the technical criteria for a valid view in order to ensure the fairness of the system.
Method for calculating creator revenue

This Annex describes, in a clear and transparent way, how NetMovIA calculates and distributes revenue intended for creators. It complements Article 7 of the Creator Terms.
1. General principles
For each calculation period (for example monthly), NetMovIA applies a distribution model based on:
- actual subscription revenue;
- the number of valid views generated by each creator;
- a coefficient system (performance bonus) applied according to the creator’s rank.
The current breakdown is as follows:
- 30% of subscription revenue is allocated to the Creator Remuneration Fund;
- 70% is retained by NetMovIA to cover technical, hosting, API, support, development and infrastructure costs.
The amount actually paid to each creator depends in particular on:
- their share of the weighted valid views in the total weighted valid views on the Platform;
- their compliance status (no fraud, KYC completed, full tax information);
- the availability of a valid and eligible payment method.
NetMovIA does not guarantee any minimum income or payment frequency for any given Creator. Revenue may vary significantly from one period to another depending on the number of subscribers, their usage, overall viewer behaviour and the relative performance of the different works available on the Platform.
2. Valid views and weighted units
The calculation is done in two stages: first valid views, then weighted units.
2.1 Valid views
A view is considered valid when all of the following conditions are met:
- viewing carried out by an authenticated user (active account);
- viewing of at least 80% of the video’s duration, whatever its total length;
- a subscriber can generate only one valid view per film for the film’s entire lifetime (one view per film, per subscriber);
- no fraud or automation signals (bots, click farms, coordinated multi-accounts, abnormal behaviour);
- viewing carried out in a geographic area eligible for payment;
- public film, published and currently available on NetMovIA.
NetMovIA reserves the right to adjust the technical definition of a valid view in order to maintain the integrity of the system.
2.2 Rankings, Tops and coefficients
At the end of each calculation period, NetMovIA ranks creators according to their number of valid views for the period, from highest to lowest. For each creator, all valid views generated by all of their films during the period are added together.
For each calculation period, let N be the number of Creators meeting the eligibility conditions for the Creator Fund. NetMovIA remunerates at most the top 100 Creators for the period. We therefore define Nₑ = min(N, 100) and keep only the Creators ranked from 1st to Nₑ-th place.
Each Creator is assigned a rank R between 1 and Nₑ, according to their total number of valid views across all of their creations during the period. This rank is unique: a Creator can only appear once in the ranking, belongs to only one Top and can receive only one payment linked to the Creator Fund for the period.
The Tops and their coefficients are then applied automatically according to the rank R, within the limit of eligible creators (Nₑ):
- Top 1: if R = 1 → coefficient ×10
- Top 5: if 2 ≤ R ≤ min(5, Nₑ) → coefficient ×6
- Top 10: if 6 ≤ R ≤ min(10, Nₑ) → coefficient ×4
- Top 25: if 11 ≤ R ≤ min(25, Nₑ) → coefficient ×2.5
- Top 50: if 26 ≤ R ≤ min(50, Nₑ) → coefficient ×1.5
- Top 100: if 51 ≤ R ≤ Nₑ → coefficient ×1
Where the number of eligible Creators is below certain thresholds (for example N < 25, 50 or 100), the corresponding Tops are simply partially filled or empty for that period. There is no minimum number of views fixed in advance to enter a Top: it is enough to be better ranked than the other Creators during the relevant period.
For each eligible creator, we then calculate their weighted units:
These units do not represent money in themselves: they are only used to determine each creator’s relative share of the Creator Fund.
Once each creator’s units have been calculated, we determine the total units for all eligible creators.
Steps of the calculation:
- Calculate each creator’s valid views for the period;
- Rank creators by valid views and assign a coefficient according to their rank;
- Calculate each creator’s units (valid views × coefficient);
- Calculate the sum of all creators’ units (total units);
- Determine the value of one unit from the Creator Fund (30% of subscription revenue);
- Calculate each creator’s share by multiplying their units by the unit value.
Formulas used:
Unit value = Creator Fund ÷ Sum of all units
Creator revenue = Creator units × Unit value
This mechanism guarantees mathematically that the total amount distributed to creators can never exceed 30% of subscription revenue.
On request, NetMovIA may provide the Creator with a summary of the elements used to calculate their remuneration for a given period (valid views, units, unit value), within the limits of available data and in a reasonably usable format.
In the event of a proven technical error in a calculation (bug, unusual rounding issue, etc.), NetMovIA will correct the relevant amount either by adjusting the current period or one or more subsequent periods so as to restore the correct total amount due to the Creator.
4. Clear example (illustration)
The figures below are provided purely as an example and do not constitute a contractual commitment. They simply illustrate how the model works with several creators having different performance levels.
- Subscription revenue for the period: €19,900 (10,000 subscribers at €1.99);
- Creator Fund (30%): €5,970.
Suppose that during the period, 10 creators generate the following numbers of valid views, with different ranks and coefficients:

In this example, there are only 10 eligible Creators for the period (N = 10). The number of creators taken into account is therefore Nₑ = min(N, 100) = 10: all 10 Creators share the Creator Fund.
- Rank 1 is in Top 1 (coefficient ×10);
- ranks 2 to 5 are in Top 5 (coefficient ×6);
- ranks 6 to 10 are in Top 10 (coefficient ×4);
- Tops 25, 50 and 100 are empty for the period because there are not enough eligible creators.
For example, Creator C is 3rd in terms of valid views for the period: they are therefore in Top 5 (coefficient ×6). With 7,000 valid views, they obtain 7,000 × 6 = 42,000 units, which then determines their share of the Creator Fund.
This example shows how the formula adapts automatically even when the Platform has only a few active Creators at the beginning: the ranking is always based on each Creator’s valid views and the distribution remains mathematically capped at 30% of subscription revenue for the period.
In this example, the total units amount to 268,200. The value of one unit is then determined as follows:
Each creator’s revenue equals the number of units attributed to them multiplied by the unit value. The amounts shown in the table are rounded to the nearest cent. NetMovIA may adjust any rounding so that the total paid exactly matches the Creator Fund for the period.
In reality, the Platform may have dozens, hundreds or thousands of creators. There may therefore be several creators in each Top (Top 1, Top 5, Top 10, etc.). The number of views required to reach a given rank varies from period to period: it depends on overall subscriber behaviour and the performance of other creators and is therefore not fixed in advance.
Each creator’s revenue equals the number of units attributed to them multiplied by the unit value. The total revenue paid to the 10 creators in this example is equal to the Creator Fund, i.e. €5,970.
Whatever the number of creators, views or coefficients, the mechanism guarantees that the total revenue paid out remains strictly capped at 30% of subscription revenue for the period.
5. Exclusions and checks
NetMovIA may exclude certain views or accounts from the calculation in cases of:
- proven or strongly suspected fraud;
- non-human or automated viewing;
- multiple accounts used by the same person;
- bypassing limitations or security tools;
- rights issues, legal claims or breaches of the Terms.
6. Payment thresholds and verification
- A minimum revenue threshold may be required to trigger payment (for example €20 or €50);
- When the monetisation system becomes active, payments will only be made after identity (KYC) and, where applicable, tax status have been verified;
- NetMovIA may request tax documentation (SIRET number or equivalent depending on the country);
- Payments deemed fraudulent or irregular may be blocked, cancelled or delayed.
7. Changes to the model
NetMovIA may adjust the coefficient grid, thresholds or certain technical parameters in order to maintain a fair system, resistant to fraud and adapted to the evolution of the Platform. Any substantial change to the remuneration model will be notified to creators in an appropriate manner.
Creator’s tax obligations
The Creator remains solely responsible for declaring their income to the competent authorities (author status, micro-enterprise, company, international regime, etc.).
No payment can be made without the required tax or banking information, or where the legislation applicable in the Creator’s country of residence does not legally allow payment.
Before any payment, NetMovIA may request supporting documents, in particular:
- identity document;
- SIRET number or equivalent depending on the country;
- bank details;
- tax residence certificate.
Payments
Practical arrangements (minimum amount, payment frequency, payment methods) are specified in the Creator area. No payment can be made in the event of suspected fraud, dispute or incomplete information.
To preserve the integrity of the Platform, NetMovIA implements fraud-detection mechanisms (bots, abnormal behaviour, attempts to artificially inflate views, etc.).
In particular, the following are prohibited:
- creating or using scripts, bots or automated services to generate views;
- massive or coordinated self-viewing intended to manipulate ranking or revenue;
- creating multiple accounts solely to multiply views or rewards;
- account sharing in breach of the general Terms.
In case of suspected fraud, NetMovIA reserves the right to:
- temporarily suspend the Creator account and the associated payments;
- cancel views, revenue or rewards deemed fraudulent;
- permanently terminate the account, with or without notice, depending on the seriousness of the facts;
- bring civil or criminal proceedings where appropriate.
8. Personal data
In the context of the Creator relationship, NetMovIA processes certain personal data (for example: stated identity, username, e-mail address, connection data, activity logs, and, where applicable in the future, payment information via a third-party provider once paid features are activated, etc.).
Full details of these processing activities, their purposes, retention periods and the Creator’s rights (access, rectification, erasure, objection, portability, restriction) are set out in the Privacy Policy available on the site.
9. Term, suspension and termination
This contractual framework is concluded for an indefinite period from acceptance of the Creator Terms and remains applicable for as long as the Creator account is active.
The Creator may at any time request deletion of their content and/or closure of their account via the tools available in their account area or by contacting support.
NetMovIA may suspend or terminate a Creator account, with or without notice, in particular in cases of:
- breach of these Creator Terms or the general Terms of Use;
- manifestly unlawful content or content contrary to public policy;
- fraud, attempted fraud or circumvention of security systems;
- repeated non-payment of subscriptions or serious payment incidents.
Termination for serious breach may lead to the permanent loss of access rights, cosmetic rewards and revenue not yet paid, subject to any mandatory legal provisions.
10. Changes to the Creator Terms
NetMovIA may amend these Creator Terms to take account of service developments, regulatory changes or industry practices.
In the event of a substantial change, the Creator will be informed by an appropriate means (notification on the Platform, e-mail, etc.) with reasonable prior notice. Continued use of Creator mode after the new terms come into force constitutes acceptance of them.
11. Governing law and jurisdiction
These Creator Terms are governed by French law.
In the event of a dispute and failing amicable resolution, the competent courts shall be those of the jurisdiction of the domicile of the person responsible for the NetMovIA service, subject to any more protective mandatory provisions that may apply.
